An impeachment process would be the right method,
BUT realistically seen your country cannot afford it b/c of Iraq.
So you better should help this crazy guy (yes help him!) till
his time is over, I think Oct or Nov this year.
You have to think about the consequences for the US should he
be forced to leave now. It would not be the right step for your country.
If you can prove the points you listed then _later_ you still can try
to bring him to court.
It's a problematic situation at the moment I know, but
you have to think for the interesst of your country and the whole nation.

Sadly, the god of the Greedy Oil Pirates is exposing the US to what it
was all along a third class leadership sitting on top of genocidal
megalomaniacs, asset stripping other cultures.
And with the Joke Chimp Chump being so publically a dim wit, there is
no way of dodging the truth. The shambles that is New Orleans is being
handled no better than Pakistan has handled the earthquake disaster in
Balakot, Kashmir.
But Pakistan doesn't have the same infrastructure the the US has and it
has a territorial war right on the spot. So they at least have some
sort of an excuse.
In every other way (not just that outstanding example) the USA under
George Bush, has shown itself vulnerable to every Dumbyass plot that
can go wrong, going wrong. When the money finally runs out, they will
be in the same position Russia was in after its perestroika.
If you didn't know better you would say that the US was not a world
class power but a banana dictatorship. A few spiteful locals in Iraq
are making monkeys out of them.
I'm not talking about Mahdi Armies of tooled up fundamentalists but
newspaper boys and market stall holders with a grievance. The US and
British forces have "got the indian sign on them".

U.S. domination and aggression with Cuba
by Peter Bohmer who is a faculty member in Political Economy at the
Evergreen State College in Olympia, WA.
Cuban society is not the dictatorship you hear about in the media here;
people do speak up and criticize, and there is no torture or
disappearance of dissidents.
During the 1895-1898 Cuban war for independence, the U.S. intervened
militarily, claiming to support independence for Cuba, but then
dominated Cuba economically and politically until 1959. As a condition
for the U.S. ending its military occupation of Cuba, Cuba had to sign
the Platt Amendment, which was the basis for establishing the U.S. base
in Guantanamo, Cuba. Today in Guantanamo, prisoners from around the
world are being held indefinitely with no rights and subject to brutal
treatment by the U.S. military. In addition, the U.S. and Cuban elites
dominated Cuba from 1902 to 1959, with the U.S. sending troops and
supporting Cuban governments who were favorable to U.S. gangsters and
other shady investors and undermining those who weren't.
The United States Blockade. During the period of Cuba's alliance with
the U.S.S.R., the U.S. claimed that hostility towards Cuba was because
Cuba was an extension of the U.S.S.R in the Americas. However, notice
that the U.S. intervention has become even more aggressive since the
collapse of the U.S.S.R, which should lead us to question the U.S.
rationale in the past as well as the present. The U.S. embargo, which
the Cubans call a blockade, because it limits Cuban trade with other
countries besides the U.S., means that Cuba has had to pay a higher
price for goods on the world market that it imports such as medicines
and food, and has had to maintain a larger military budget than it
would otherwise. The blockade has also significantly reduced Cuba's
ability to export, which in turns means its ability to import has also
been reduced. This is the context for understanding Cuba today. So when
U.S. leaders and academics say Cuba is a failed experiment,
economically and politically, they ignore this context.
Overall Assessment
Cuban's survival in the face of the U.S. attempt to destroy the Cuban
revolution is a great achievement as is Cuba's continuing to provide
for the basic needs of its population. For example, every single person
in Cuba has free dental and eye care. Every person in Cuba with AIDS
gets free, high-quality retroviral drugs.
Our responsibility as U.S. residents is to stop the criminal
embargo/blockade against Cuba that is being waged by the U.S.
government in our name. For 45 years, the people in power in the United
States have been unwilling to accept a sovereign, independent Cuba.
That is the main reason behind the past and present immoral and illegal
U.S. actions against Cuba; we have the responsibility to change U.S.
policy. During our six weeks in Cuba, we were all impressed by how well
we were treated and received by the Cuban people and government who
consider the U.S. people, but not the U.S. government as their friends.
It is up to us to make the difference between the people of the U.S.
and our government greater, to make our government's aggression against
Cuba so unpopular in the United States that it is forced to accept
Cuban sovereignty.
If the people in the United States are successful in getting our
government to end the blockade, U.S. tourism to Cuba will grow
exponentially. This will cause new problems in Cuba such as a growing
desire for a first world standard of living, but it is up to Cubans who
unanimously want the blockade to end, to deal with this.
In so far, as we work to end the blockade, we have a right to humbly
criticize the Cuban system although the U.S. government does not have
that right given its past and present policies. Cuba is as just as any
country in the world; it deserves critical support from the people of
the U.S. but there are real problems.
Cuba has not developed a workable strategy for simultaneously achieving
economic and social equality, people's power and an improving quality
of life. The main efforts of the Cuban government have been to survive,
to maintain basic services and to increase economic production. They
have accomplished the first two of these objectives but have not so far
developed a strategy for sustainable economic development. Economic
growth is necessary; otherwise increases in needed services such as
public transportation comes at the expense of other needed goods and
services. Possibly, increasing worker participation and power in work
places could lead to higher productivity and production.
Income inequality is still worsening. Income equality could be improved
by increasing the types and quantity of goods available at subsidized
prices on the ration cards, and/or moving to one currency and price
system and raising wages substantially for those getting paid in pesos.
However, unless production is increased substantially and higher
incomes are taxed more heavily than now, these reforms will cause huge
inflationary pressures as demand increases; and increase balance of
payments problems as imports increase.
Cuban society is not the dictatorship you hear about in the media here;
people do speak up and criticize, and there is no torture or
disappearance of dissidents. There is some suppression of the organized
opposition. This repression is because of the fear and the reality of
the U.S. commitment to overthrow the Cuban revolution and return Cuba
to a neocolonial status. We need to understand the context for Cuban
government behavior without necessarily supporting it. The U.S.
government does support much of the opposition in Cuba, for example,
the 75 Cuban dissidents who were arrested and imprisoned in 2003. If
Cuba openly financed opposition to capitalism in the U.S., or
intervened in the U.S. elections, think how people in the U.S.
receiving money from the Cuban government would be treated. Also, the
U.S. is a clear threat to Cuba; Cuba is not to the United States,
meaning that Cuban fears and actions are more justifiable than the
United States actions would be.
Nonetheless, there is only a limited role for worker control in Cuban
enterprises, and the state-owned media is limited in its criticisms of
the government. Because daily life is difficult and time-consuming in
Cuba, participation and activism in public life have declined. Cynicism
and dissatisfaction have grown, particularly among the young. The
Special Period has been particularly hard for women as it has meant
that maintenance of the family and family responsibilities take more
time, e.g., the decline in public transportation, and there is less
income available. The burden of this time and money squeeze has mainly
fallen on women so they have less time than before for participation at
the workplace, in the community and in the women's federation.
However, the Cuban revolution, the concept of socialism and Fidel
Castro and the Communist Party are seen as legitimate by the majority
of the population, and the overwhelming majority would fight in support
of the revolution if the U.S. invaded. During our trip, we heard from
many different Cubans that they and the revolution will persevere even
with the most recent May, 2004 tightening of the blockade. This
includes the reduced possibilities of U.S. travel to Cuba for
educational purposes as well as by Cuban Americans, the increased
funding by the U.S. government of groups who are actively trying to
overthrow the Cuban government and of anti-Cuban propaganda, and other
measures aimed at isolating Cuba and hurting the Cuban economy
byreducing their access to foreign exchange.
The Future of Cuba
The Cuban government and many Cuban people fear a U.S. invasion. I
think it is possible although not likely. There will, however be
increased pressure and aggression against Cuba since Bush was
reelected. U.S. provocations such as flying military planes with radio
and TV transmitters, which Bush announced on May 6, 2004, could lead to
violations of Cuban airspace and U.S. military attacks on Cuba if Cuba
defends itself against these violations. John Kerry's position on Cuba
was not as bad as the current administration's but he does not accept
Cuban self-determination and sovereignty as the basis for U.S. foreign
policy. Kerry has said, if elected President, he would end the travel
ban but he would not end the embargo/blockade or establish normal
diplomatic relations with Cuba. If we are concerned about human rights
and the right of all nations to choose their own system, we should do
what we can to stop the U.S. from waging war against Cuba, whether it
is an invasion or the continuing blockade.
In conclusion, the survival and maintenance of the Cuban Revolution is
incredibly important for the Cuban people and globally. It is an
alternative to neoliberalism and a beacon of hope for oppressed people
around the world. I am often asked what will happen after Fidel Castro
retires or dies. I think there will be no big changes immediately in
Cuba nor will U.S. hostility end as it is aimed at the Cuban system not
just at Castro. My hope for the future of Cuba is that as we work to
reduce U.S. aggression, and as Cuba gains more economic and political
allies in the world such as Venezuela, that Cuba will experiment with
more people's democratic power and build a socialism that is
participatory, egalitarian, and increasingly meets the needs of its
people.

Cope en su edición de fin de semana, explicó que los cubanos no se

puesto que reivindicó la Cuba de la dictadura de Batista como uno de
los países más desarrollados de la época.
En la presentación del libro, este cubanoamericano que añora la ayuda
de Hitler y Musolini estuvo acompañado del poeta cubano Raúl Rivero y
de Alberto Recarte, vicepresidente de la Fundación Hispano Cubana, una
asociación ligada al Partido Popular. Ambos se extendieron en halagos
hacia el autor.
Humberto Fontova, que habla con un español con claro acento
estadounidense debido a que salió de Cuba con siete años, argumentó
su discurso en su entrevista en la COPE, llamando "imbéciles a
quienes se ponen camisetas del Che Guevara". Según él, el argentino
mató, "500 cubanos, otros dicen 700 y otros 1862". Quizás fue por
esta precisión por la que Raúl Rivero calificó el libro, durante su
presentación en la Fundación Hispano Cubana, de escrito " con razón,
información y rigor". Reconoce Fontova que existe un gran apoyo en
el mundo de la cultura y el cine a la revolución cubana. La razón,
según señala, no es otra que el chantaje al que son sometidos tras
haberles grabado en las habitaciones de los hoteles el gobierno cubano
cuando disfrutaban del turismo sexual.
También nos aclaró que en Cuba no hubo una guerra de guerrillas de
Fidel Castro y el Che contra Batista, sino que la guerra de guerrillas
fue entre 1960 y 1966 contra Fidel y el Che. A pesar de que eran 159
grupos insurgentes no vencieron porque no les ayudó Estados Unidos,
afirma.
Del Che nos ofrece una información desconocida hasta ahora, y por
supuesto rigurosa y coherente: "El Che odiaba el rock and roll y el
pelo largo, que él mismo llevaba, y todas esas cosas de la juventud".
El cubanoamericano, animado por el presentador de la COPE, también
hace un llamamiento internacional contra Fidel Castro y pide que los
gays y lesbianas se movilicen indignados contra la represión de la
homosexualidad en Cuba. No nos imaginábamos a la radio de la
Conferencia Episcopal tan preocupada por los derechos de los
homosexuales. Ante lo cual se me ocurren varios comentarios, primero
que por qué se tiene que rebelar los homosexuales y no los
heterosexuales; y segundo que por qué contra la represión de los
homosexuales si, según dice, la represión es contra todo el mundo. Y,
por último, si fuese a Cuba vería que los homosexuales que, según
dice están en campos de concentración, donde están es tomando ron en
el malecón donde se reunen todas las noches y que el parlamento cubano
está estudiando una propuesta para realizar gratuitamente las
operaciones de cambio de sexo en el sistema de salud cubano.
Con el rigor periodístico habitual de la COPE, el entrevistador,
Dieter Brandau, le sugirió al entrevistado que les diese "un poco de
esperanza" y le preguntó que pasará en Cuba "cuando fallezca el
monstruo". Fontova respondió que "el problema es que Fidel Castro
tiene 79 años y su padre y su madre vivieron hasta los 94 y 95 años
de edad". El periodista imparcial le responde: "le he pedido un
mensaje de esperanza, no me diga que tenemos que aguantar otros veinte
años a este genocida". El cubanoamericano responde que "hay gente
que dice que es Raúl Castro el que gobierna desde hace seis o siete
años, por lo que si Estados Unidos no ayuda, seguiremos igual".
Parece que, en su opinión, no corresponde a los cubanos decidir su
futuro sino a la Administración Bush, que deberá ayudarles a alcanzar
la democracia con la misma eficacia con la que está ayudando a los
iraquíes.
El periodista de la COPE, con esa imparcialidad que caracteriza a los
medios de nuestras democracias termina diciendo que "seguiremos dando
la batalla mediática contra el tirano".

Dear Mr. President Bush:
We the undersigned, concerned members of the Cuban-American community, write
to request your intercession on behalf of Mr. Luis Posada-Carriles, a Cuban
currently detained by the Department of Homeland Security, Immigration and
Customs Enforcement, to effectuate his removal from the United States.
The Department of Homeland Security is detaining Mr. Posada-Carriles to
remove him to a "third country,"-excluding Cuba or Venezuela- for an
immigration judge prohibited such action. The fact is that Mr.
Posada-Carriles would not be safe even if a "third country" were to accept
him, for he has been a target of assassination attempts by Cuban
intelligence Agents in several countries, including Guatemala, where his
face was disfigured by wounds in 1990.
The facts are: (1) Mr. Posada-Carriles has never committed or been charged
with a crime in the United States and simply entered the United States
illegally only to seek refuge from Castro's death squads; (2) Mr.
Posada-Carriles has served the U.S. in an exemplary manner, having served as
a Lieutenant in the U.S. Army and as a covert operations agent for the
Central Intelligence Agency in what was then known as the "Southern Front"
against communists backed insurgents and guerilla groups which presented a
threat to U.S. national security in the 70's and the 80's; (3) the Cuban and
Venezuelan governments level terrorism accusations against Posada-Carriles,
however, he has not been convicted and has in fact twice been acquitted of
terrorist acts by a Venezuelan Court; (4) finally, and contrary to the
Department of Homeland Security's assertions in their decision to not
release Mr. Posada-Carriles, he simply does not represent a threat to the
security of the U.S., a nation he has defended with his life.
Now, 78 years old and in frail health, Mr. Posada-Carriles deserves to be
reunited with his family and his grandchildren. The Department of Homeland
Security is now illegally detaining Mr. Posada-Carriles past the time
allowed by the Supreme Court (6 months) in Zadvydas v. Davis, 533 U.S. 678
(2001) and in Clark v. Martinez, 543 U.S. 371 (U.S. 2005).
The federal courts will eventually find that Mr. Posada-Carriles' detention
is unnecessary and therefore will release him. However, the fact remains,
Mr. Posada-Carriles is a 78 year old man who suffers multiple medical
ailments and who is beloved by the Cuban American exile community. Mr.
Posada-Carriles deserves to spend his remaining days among his loved ones.
Mr. President, we respectfully requests that you release Mr.
Posada-Carriles. Please, do not allow Mr. Posada-Carriles to die an old man
in an immigration prison, away from his loved ones.

Dubrovnik, CROATIA, April 6 (FPB) - A Boeing 737 used by CIA to
transport terrorism suspects between 2002 and 2005 had twice landed at
Dubrovnik Airport, this according to an Amnesty International report
published on its website. The plane that had touched down in Croatia
twice is said to be the one transporting German national Khaled al
Masri mistakenly accused of being a terrorist. No details regarding the
flights have been published. The airspace of several other countries

Este siglo XXI nos revela un mundo amenazado por innumerables males y
prisionero en una gigantesca red de tensiones. Incomunicación, sensación de
vacío, ansiedad, resentimiento, envidia, insatisfacción, parecen ser
ingredientes significativos en el sentir de los hombres de nuestros días.
Drogas, suicidio y corrupción se anuncian como respuestas ante la
frustración que crece.
Una visión panorámica del Planeta y de los cataclismos que lo acechan suele
provocar impotencia y perplejidad. Se ha llegado a presentar diagnósticos y
pronósticos terribles que causan angustias casi invencibles. Las soluciones
de fondo que se proponen están en consonancia con la estimación que en cada
caso se practique de la realidad actual tan confusa y compleja.
Se aprecian valiosos esfuerzos de interpretación de la crítica situación
contemporánea. Especialistas preocupados que investigan en las diversas
disciplinas hacen oír sus voces de alarma. Autores serios alertan ante la
existencia de crisis profundas en determinadas áreas del obrar humano.
Algunos sostienen que la principal de esas crisis se verifica en el campo
político; otros -partidarios del monismo materlialista- entienden que la
crisis fundamental es de carácter económico y también hay quienes están
persuadidos que la causa de toda crisis es de orden sociocultural.
No existe actividad humana con relación a la cual no se haya señalado graves
deterioros. Esto autoriza a pensar que estamos en presencia de un desorden
integral.
La acción política, la economía, las relaciones sociales, la vida cultural
toda, constituyen diversas formas de realización de un mismo protagonista:
el hombre. De allí que esas diversas crisis que se denuncian no son más que
facetas distintas de una sola crisis fundamental que tiene al ser humano
como primer escenario. En efecto, el proceso de crisis que sacude al mundo
tiene su raíz más profunda en el mismo hombre. Desde él se proyecta hacia
todos los dominios de su actividad. Si la sociedad actual está enferma es
porque la enfermedad afectó la personalidad del ser humano y contaminó -en
mayor o menor grado- todas sus realizaciones.
La crisis se manifiesta en todas partes. Lo invadió todo, nada escapa a su
creciente poder destructor. Es total, universal y progresiva. Parece ser la
más profunda y dominante que registra la historia.
Esa crisis principal y única tiene como primer campo de acción la
interioridad de cada hombre y las tendencias desordenadas que habitan en él
constituyen su fuerza propulsora (Plinio Corrêa de Oliveira, «Revolución y
Contra-Revolución»).
Las tendencias descontroladas logran modificar la mentalidad, alteran el
modo de ser personal, incidiendo directamente en el terreno de las ideas.
El desarreglo tendencial impulsa el surgimiento de ideas que tienden a
justificar el desorden interior que se experimenta. Desde el plano de las
ideas se extiende al campo de los hechos: luego de concebida la idea, ésta
se traducirá en el obrar concreto del hombre. El hacer práctico de cada
hombre y las realizaciones de los grupos humanos en los diversos órdenes,
tienen su causa primera en las tendencias más profundas.
Todo hombre posee el irrenunciable derecho a buscar y conocer la Verdad, a
creer firmemente en ella y a defenderla por todos los medios lícitos. El
ser humano aspira a encontrar la verdad y a practicar el bien. Y
efectivamente, puede llegar a poseer la verdad mediante el ejercicio de la
recta razón auxiliada por los sentidos.
Dado su carácter racional, el ser humano -dotado de voluntad libre-
procurará obrar consecuentemente con sus ideas. Actuará "conforme a su modo
de pensar, so pena de terminar pensando tal como actúa".
Los hombres buscan, necesariamente, principios e ideales nobles que den
sentido a su existencia. Vivir sin ellos conduce fatalmente a la
frustración, al derrumbe intelectual y al caos moral.
Sólo es capaz de sacrificios por un ideal aquel hombre que posea firmes
convicciones y que haya hecho de ese ideal el centro de su vida, la razón de
su existencia. Las convicciones que se traducen en ideales son motores de la
historia personal y universal. Los ideales son chispas capaces de incendiar
los mayores entusiasmos al servicio de una vida que valga la pena ser
vivida.
Desorientado e insatisfecho, el hombre contemporáneo se encuentra abrumado
por las infinitas dudas que debilitaron sus convicciones. Para todas las
certezas aparecen escépticos y negadores sistemáticos.
Se está pisoteando la distinción entre la verdad y el error. Se afirma que
ninguna verdad es tal y que la única seguridad radica en que todo es
inseguro. Se niega la verdad como «algo que es» y, paradójicamente, con
carácter absoluto se llega a aseverar que todo es relativo. Solo parece
importar la subjetividad que lo relativiza todo y resquebraja el orden
moral. Surge el dogma del antidogmatismo.
Hoy se escuchan con alarma las más sutiles prédicas de menosprecio o de
negación de las nociones éticas fundamentales. Las distinciones entre el
bien y el mal vienen siendo destruidas paulatinamente.
Ciertas corrientes filosóficas y jurídicas se niegan a reconocerle validez a
la ley moral o le dan a ésta fundamentos débiles o ridículos. De este modo
se facilita el advenimiento del más radical desconocimiento de toda norma
moral.
Los principios éticos son presentados como si fueran simples
convencionalismos o usos sociales o tabúes o mitos. Es tal la descomposición
que las normas morales son consideradas por algunos como supersticiones o
prejuicios detestables. Se pretende amordazar la conciencia moral.
Parecería que el progreso material viene acompañado de una progresiva
decadencia moral y de una gravísima corrupción ideológica. Debilitada la
fortaleza moral, avanza la degradación y se pierde la identidad personal,
mientras que se hace cada vez más frecuente la manipulación de las
conciencias.
Ya no pasa inadvertida la acción de cierta propaganda que, sin atreverse a
afirmar descaradamente que la ética no existe, hace abstracción de ella. Se
fomenta la veneración de ídolos tales como el confort, el mero placer de los
sentidos, la riqueza puramente material, la utilidad práctica inmediata,
etc. Parece importar más que algo sea útil antes que verdadero o legítimo.
Se insinúa que la obtención de felicidad para el hombre solo es posible
cuando -gracias a la técnica y a la ciencia- disfruta, sin freno y sin
orden, de comodidades, dinero, prestigio, fuerza muscular, belleza física,
etc. En consecuencia -dicen- hay que procurar hacer de esta Tierra un
paraíso técnicamente delicioso en completa libertad, idolatrar el tecnicismo
hipertrofiado, adorar la máquina y la velocidad.
Es como pretender hacer de cada hombre un ególatra, postergando o negando lo
espiritual, mientras se le da preeminencia a todo lo material.
No es difícil encontrar como fundamento último de determinadas corrientes
filosóficas una concepción inmaculada del hombre que pretende presentarlo
dotado de una razón infalible, de una voluntad omnipotente y de tendencias
siempre ordenadas y perfectas. Un hombre tan perfecto y autosuficiente por
la acción de la técnica y de la ciencia que será capaz -dicen- de eliminar
el dolor, el sufrimiento y todo mal de la faz de la tierra. Tan omnipotente
que llegará a prolongar la vida indefinidamente porque confía vencer a la
misma muerte. Es la ilusión de un ser humano inmejorable, casi divino o ya
deificado.
El hombre de hoy está cansado de las urgencias de lo inmediato, está
saturado de la rutina mecanizada y frenética, está hastiado de hedonismo
materialista. Busca lo absoluto, lo necesita. La velocidad de lo contingente
no logra hacer desaparecer la natural preocupación por los profundos
misterios vitales.
La sed de verdad, la apetencia de saber y el anhelo cognoscitivo no se
sacian con electrodomésticos. El imperativo del Bien y el hambre de Justicia
no desaparecen porque podamos correr a enorme velocidad en un auto super
sport.
Se intenta dar la espalda a la vida y a sus misterios. Se pretende fugar
ante lo más serio de la existencia humana y por ello se termina -quiérase o
no- en el laberinto de un mundo sin sentido.
Cada hombre al apartarse de la Verdad, queda como ciego ante la vida y sus
maravillas, sordo porque no escuchará sus mensajes y mudo porque no podrá
responder a sus más profundos interrogantes.
El significado de la creación está más allá del telescopio. Tampoco se le
encuentra en un tubo de ensayo ni se llega a él tripulando naves
interplanetarias. Es dentro del mismo hombre que viven esos valores que
responden a un orden universal. Son los valores morales los que justifican
y ennoblecen la vida humana. Esos mismos valores que se empeña en negar el
materialismo ateo, del cual millones de almas ya han probado sus amargos
frutos.
Necesitamos el antídoto para combatir la fiebre materialista que amenaza
convertir nuestras vidas en vacías. El recto y auténtico progreso implica el
pleno desarrollo de las potencias del alma, la prevalencia de los valores
espirituales sobre los aspectos materiales. Supone la ascensión de los
hombres rumbo a la perfección moral.
Se quiere fomentar el más crudo hedonismo materialista. Para ello se
exacerban los apetitos sensibles y se estimulan las pasiones desenfrenadas.
Parecería que la meta es instaurar la tiranía de las pasiones mediante el
debilitamiento de la razón y de la voluntad. Sin el control eficaz de la
razón y sin la participación de la voluntad, el hombre queda a merced del
instinto, de impulsos y de reacciones primarias. Es como si se quisiera un
comportamiento humano animalizado, espontáneamente anárquico.
Hasta los peores vicios cuentan con defensores que fabrican justificaciones
para ellos. Se llega a hacer la apología de las prácticas más corruptas y
repugnantes.
Parecería que una enorme presión ambiental intenta hacer creer que la
libertad es sinónimo de desenfreno, de ruptura con todo principio, con toda
autoridad y con toda norma. En tal sentido se presenta como paradigma del
hombre libre al más anárquico, impulsivo e irracional.
Se está promoviendo la negación del hombre como ser inteligente. Se ha
llegado a declarar la guerra contra la razón para evitar que el hombre sea
«alienado» por ella. La consecuencia de este querer «liberarse de la razón»
es la peor esclavitud: la del instinto.
En vez de exacerbar el ansia de libertad sin límite, lo justo y conveniente
sería que se entendiese la libertad como conquista y señorío del yo. El
hombre auténticamente libre es dueño y responsable de sus actos (y
omisiones). Es persona (per-se uno) dueño de sí mismo y protagonista de su
existencia.
La libertad debe ser entendida como posibilidad de opción entre el bien y el
mal. Supone autonomía con respecto al sentir colectivo y clara
responsabilidad en el ejercicio de los derechos y en el cumplimiento de las
obligaciones.
No es posible concebir la crisis en todo lo humano prescindiendo de la
crisis que afecta la educación. Si se quiere armonía y justicia en lo
social, es necesario cultivar esos valores en el alma de los integrantes de
la sociedad.
Vivimos en un mundo en ruinas y cada hombre es testimonio de los efectos de
la profunda crisis pedagógica. Hoy encontramos al hombre sin clara
conciencia de su fin último, dudando de su mismo origen y de todo lo que le
rodea.
Hay quienes insisten en que se vea al hombre como un mero trozo de carne
llamado a venerar la tecnología, un montón de materia que existe para adorar
la máquina.
Es claro que quien crea que nada existe fuera de la materia, niega a Dios y
al alma humana. Esa misma concepción materialista impedirá la aceptación de
valores espirituales.
Si la educación procura atender las necesidades de cada época, no podrá -en
este momento histórico- desconocer la crisis que nos afecta y debe
reaccionar ante ella.
La tarea educativa es, en lo cultural, la de mayor importancia. Únicamente
puede concebírsela rescatando lo propiamente humano, descubriendo y
cultivando valores superiores.
Será preciso educar con miras al conocimiento de las causas de los males
presentes, de modo tal que pueda diagnosticarse con seriedad y, en función
de ese diagnóstico, encauzar las soluciones adecuadas.
La educación no puede perder su preocupación por la dignificación espiritual
del ser humano y la realización de los valores morales permanentes que el
legado cultural trasmite a través de las generaciones. Debe permanecer
vigente el esfuerzo por procurar el mejoramiento ético de cada persona y de
la sociedad toda.
Se han realizado esfuerzos loables por la perfección pedagógica pero se
llega a ignorar o negar al espíritu. Esa negación es la causa profunda de la
crisis actual. En tal sentido, se ha señalado como causa del deterioro
pedagógico la ruptura con las tradiciones culturales del occidente
cristiano. Darle la espalda a los valores del cristianismo y a los
fundamentos de su moral racional nos condujo al desastre actual.
Sólo habrá reconstrucción o restauración en la medida que, con paso firme,
se retorne a los valores espirituales y se ponga límite a la ebriedad de
técnica que afecta a los furiosos contra el espíritu. Modificar parcialmente
los distintos planes, programas y métodos sin revisar la concepción
filosófica en que se apoyan, equivale a dejar las cosas como están en su
proceso de materialización y deterioro creciente. Proceso éste que resulta
nefasto por ser negador de la fuerza moral que habita en cada hombre.
Si nos proponemos seriamente la «formación» de nuestros jóvenes (y no
simplemente la mera instrucción) será preciso que resolvamos, en forma
urgente y satisfactoria, los problemas más profundos de la educación que son
los referidos al modo de concebir el hombre, la vida y el mundo. Solo a
partir de allí estaremos en condiciones de saber, sin equívocos ni
ambigüedades, en qué dirección orientamos la educación a la cual debemos
dedicar nuestros mayores esfuerzos.-

AT&T Forwards ALL Internet Traffic Into NSA Says EFF
San Francisco--The Electronic Frontier Foundation (EFF) on Wednesday filed
the legal briefs and evidence supporting its motion for a preliminary
injunction in its class-action lawsuit against AT&T. After asking EFF to
hold back the documents so that it could review them, the Department of
Justice consented to EFF's filing them under seal -- a well-established
procedure that prohibits public access and permits only the judge and the
litigants to see the evidence. While not a party to the case, the government
was concerned that even this procedure would not provide sufficient security
and has represented to the Court that it is "presently considering whether
and, if so, how it will participate in this case."
"The evidence that we are filing supports our claim that AT&T is diverting
Internet traffic into the hands of the NSA wholesale, in violation of
federal wiretapping laws and the Fourth Amendment," said EFF Staff
Attorney Kevin Bankston. "More than just threatening individuals'
privacy, AT&T's apparent choice to give the government secret, direct
access to millions of ordinary Americans' Internet communications is a
threat to the Constitution itself. We are asking the Court to put a stop
to it now." EFF's evidence regarding AT&T's dragnet surveillance of its
networks includes a declaration by Mark Klein, a retired AT&T
telecommunications technician, and several internal AT&T documents.
This evidence was bolstered and explained by the expert opinion of J.
Scott Marcus, who served as Senior Technical Advisor for Internet
Technology to the Federal Communications Commission from July 2001 until
July 2005.
The internal AT&T documents and portions of the supporting declarations
have been submitted to the Court under a tentative seal, a procedure that
allows AT&T five court days to explain to the Court why the information
should be kept from the public.
"The public deserves to know about AT&T's illegal program," said EFF Legal
Director Cindy Cohn. "In an abundance of caution, we are providing AT&T
with an opportunity to explain itself before this material goes on the
public docket, but we believe that justice will ultimately require full
disclosure."
The NSA program came to light in December, when the New York Times
reported that the President had authorized the agency to intercept
telephone and Internet communications inside the United States without the
authorization of any court. Over the ensuing weeks, it became clear that
the NSA program has been intercepting and analyzing millions of Americans'
communications, with the help of the country's largest phone and Internet
companies, including AT&T.
"Mark Klein is a true American hero," said EFF Staff Attorney Kurt Opsahl.
"He has bravely come forward with information critical for proving AT&T's
involvement with the government's invasive surveillance program."
In the lawsuit, EFF is representing the class of all AT&T residential
customers nationwide. Working with EFF in the lawsuit are the law firms
Traber & Voorhees, Lerach Coughlin Stoia Geller Rudman & Robbins LLP and
the Law Office of Richard R. Wiebe.

Suing Ma Bell to Stop NSA Wiretapping: Back to the Future?

JURIST Special Guest Columnist Shayana Kadidal, one of the lead attorneys
on the Center for Constitutional Rights challenge to the NSA domestic
surveillance program, says that the Electronic Frontier Foundation's
recent suit for damages against telecommunications giant AT&T for its role
in facilitating the program has suggestive parallels in two landmark
eighteenth century English cases involving damages claims for
impermissible searches...
Last week the Electronic Frontier Foundation, together with one of the
country's biggest class action law firms, filed a motion for a
preliminary injunction in their lawsuit against AT&T for its role in
carrying out the NSA's warrantless surveillance program. The suit
itself alleges that the US government's so-called "Terrorist
Surveillance Program" is in fact not focused on terrorists but rather is
a "vast fishing expedition" directed at everyone in America -- a data
mining program using voice recognition software and the NSA's vast
array of computers to scan every phone call entering or exiting the
United States.
But unlike the suit we have filed, Center for Constitutional Rights v.
Bush, the named defendants in EFF's suit are not government officials.
Instead, EFF is suing a private party - AT&T - which supposedly
enthusiastically helped the government carry out this illegal
surveillance. Whereas our suit asks the court to order that the
program stop, EFF's also seeks damages against AT&T. And the damages are
potentially enormous: the suit is a class action on behalf of the millions
of AT&T subscribers, and the statute making this kind of surveillance
illegal (the Foreign Intelligence Surveillance Act, FISA) also provides
for minimum damages -- $100 per day per person -- plus punitive damages.
Because the allegation is essentially that every single AT&T
international call or data transmission over the last four years was
intercepted by the NSA with the active assistance of AT&T, the damages
could add up to hundreds of millions of dollars.
In searching for parallels to this wonderfully audacious suit -- an
attempt to stop government lawbreaking by seeking not a court order
against the officials responsible but a multi-million dollar jury
verdict against their private-sector co-conspirators -- I find myself
looking back two centuries. Very few Americans today can name one
Supreme Court case (Bush v. Gore? Brown v. Board?) let alone one case
(People vs. Orenthal J. Simpson?) but in colonial times, most of
America could name two cases decided across the Atlantic: Wilkes v.
Wood (1763) and Entick v. Carrington (1765). Both dealt with issues
less momentous than who would be the next president or whether public
schools could continue to be segregated. Instead, they were about the
far-less-sexy question of how broad a search warrant could permissibly be.
In Wilkes -- an English affair that became "the most famous case in late
eighteenth-century America, period" according to one scholar -- a London
publisher (John Wilkes) who had mocked the King in his writings was
pursued for seditious libel (basically, inciting rebellion through one's
writings). A broad search warrant was issued by Secretary of State Lord
Halifax -- an executive officer, not an independent judge -- allowing the
officers complete discretion to search through Wilkes' home and all his
personal papers for evidence of any crime by Wilkes or anyone else. Wilkes
himself was seized, and ended up locked away in the Tower of London.
Wilkes, eventually freed, sued for damages. He argued his own case,
calling the general search warrant issued against him "a ridiculous
warrant on the whole English nation." The judge, Lord Camden, agreed with
him, and sent the case to a jury for a verdict. The jurors returned with
an award of 1000 pounds in damages for Wilkes; he received even more from
Halifax in a suit six years later. The costs to the government in Wilkes'
case and related cases were said to reach as much as 100,000 pounds
(roughly ten million dollars in today's terms).
In some ways, the open-ended search warrant at issue in Wilkes' case was
the NSA data mining program of its day. By banning such general warrants,
Lord Camden announced a principle that the colonists would enshrine in the
Fourth Amendment, which stated that "no Warrants shall issue [except] upon
probable cause" (meaning, roughly, good reason to suspect criminal
activity) and that warrants must describe with particularity the places
to be searched and the persons or things to be seized. Because the Fourth
Amendment requires that a warrant must place limitations on a search, the
government could never get a lawful warrant broad enough to allow it to
scan every international email or listen in on every international call.
Until EFF's filing, no one had claimed to have evidence that this was what
the NSA was doing, but since colonial times everyone has known it was
illegal.
The award in Wilkes was an astronomical sum in 1763 -- a veritable king's
ransom -- and especially shocking given that it was gifted to a
spendthrift rogue like John Wilkes. Nonetheless, unlike the old lady who
spilled hot McDonalds coffee on herself, both Wilkes and Lord Camden
became instant heroes on both sides of the Atlantic after the judgment.
Patriotic parents named their children "John Wilkes" (although that
doesn't happen much anymore, for understandable reasons), and the
colonists named several counties (the Wilkes Counties in Georgia and North
Carolina) and towns (Wilkes-Barre, Pennsylvania, Camden, New Jersey and
lovely Camden, Maine) after his lordship and the plaintiff.
Wilkes even made it back into Parliament (he'd been expelled during the
seditious libel affair) and from there managed to pass into law in England
protections the independent colonists built into their new Constitution:
freedom from general warrants, and freedom to criticize the executive
during debate in Parliament. (Parliament did so in part because of the
outcome of the court cases--in stark contrast to our present situation,
where Congress seems eager to snuff out the lawsuits and whitewash the NSA
Program by passing a statute legalizing it.) In some sense, the biggest
difference between the AT&T case now and the Wilkes case then is the fact
that national security is at stake.
John Wilkes was just a harmless clown committing lese-majeste, mocking the
crown, but EFF -- the critics will charge,-- is seeking to expose the
inner workings of a vital "terrorist surveillance program" to the world by
dragging it into court.
Indeed, EFF's recent filing was quite skeletal: it did not include "a
number of internal AT&T documents" because the government claimed these
documents might include classified information, and refused to allow even
the court to review them under seal. But it is easy enough to figure out
what the documents must reveal from reading EFF's original complaint in
tandem with last Friday's filing. The complaint says that AT&T installed
or helped the government install equipment in its main facilities that
intercepts all or almost all communications that move through AT&T's
circuits. The fact that EFF has moved for relief from the court tells us
that they undoubtedly have proof of this. It's really a shocking
revelation: somewhere within the bowels of AT&T's massive switching
stations, a giant bug is delivering every phone call and email of every
AT&T subscriber to the NSA. And the government desperately wants this
truth hidden from the court and the American public.
The other case well-known to the Colonists, Entick v. Carrington,
decided by Lord Camden two years after Wilkes, involved similar
arguments for secrecy in the face of a civil claim for damages arising out
of a forcible search and seizure. As CCR's founder Arthur Kinoy put it
in his oral argument to the Supreme Court in the Keith case (1972),
establishing that President Nixon's warrantless domestic national
security surveillance was subject to the Fourth Amendment:
It stuns me a little bit to hear the arguments made by a
representative of today's executive which were made by the
representatives of George the Third in Entick against Carrington.
This court is told, as was the British court in Entick, that courts cannot
look at the reasons for the searches, that that resides in the special
knowledge of the Crown. The British court was told in Entick, you must
sanction this general search for -- and these are the words from Entick
- -- for reasons of state. For reasons of necessity. We cannot tell you
the reasons -- for they reside in the head of our executive officer,
known as the secretary of state.
These were precisely the arguments raised in Entick. Those were the
arguments the Fourth Amendment was designed to eliminate.
Then, as now, the people who opposed the claims in Entick and Wilkes
labeled the plaintiffs traitors. Let's hope the judges in the AT&T
case and our case don't agree. And that the regular-Joe phone
subscribers who are the plaintiffs in the EFF case become (like Wilkes and
Lord Camden before them) heroes too.

accepted in America. Since general history is written by the victor, I
doubt if they will ever admit this in American history books. Americans

Later that night, Roosevelt along with top advisor Harry Hopkins,
Henry Stimson, George Marshall, Secretary of the Navy Knox, with aides
John McCrea and Frank Beatty deliberately sat through the night waiting
for the Japanese to strike Pear Harbor (Toland 320). Not until the
morning of 7 December 1941 at 7:55 Hawaii Time did Japan deliberately
and forcefully attack the United States at Pearl Harbor, finally ending
disillusioned isolationist ideas of an only European War. United States
countrymen immediately ran to recruiting offices after the news of the
attack, to join the armed forces and fight against the Japanese and Hitler.
Beyond a doubt Pearl Harbor was President Franklin D. Roosevelts back
door into the European War. Roosevelts decisions and actions were very
much so, deliberate and calculated, in order to lead a victorious Allied
Powers in World War II. By provoking the Japanese and the foreknowledge
of an attack on Pearl Harbor, Roosevelt along with his top advisors and
the Federal Government are truly to blame for the lost of American
lifes and American property. 7 December 1941 shall be a day in American
history, which will be remembered as a day of deceit.
